HeroBrawl Terms of Service
The short version
- You get a personal license to play HeroBrawl — the game, and everything in it, stays ours.
- Virtual currencies and items are part of the game service. They have no real-world value and can't be sold, traded outside the game, or cashed out.
- Purchases go through Google Play. Random-reward items (chests, summons, wheels) show their drop rates in the game before you buy or spend.
- Be decent in chat, don't cheat, don't exploit bugs. Cheating or abuse can cost you items, features, or your account.
- You can stop playing and delete your account at any time. We can suspend accounts that break these rules.
- These terms don't take away consumer rights the law gives you.
These Terms of Service (the "terms") are an agreement between you and NewFound Studios ("we", "us") covering the HeroBrawl mobile game, its servers and related services (together, the "game"). By installing or playing the game you agree to these terms. If you do not agree, do not play. How we handle your data is described separately in our Privacy Policy.
1. Who can play
- You must be at least 13 years old to play — or older where your country sets a higher minimum age for digital services (for example 16 in parts of the European Economic Area).
- If you are under 18 (or the age of majority where you live), a parent or guardian must review and agree to these terms on your behalf, and must approve any purchases you make.
- You may not play if you are barred from using the service under applicable law, or if we have previously terminated your account for breach of these terms.
2. Your account
- When you first play, the game creates an account for you identified by a randomly generated player ID. You can optionally link an email address and password so you can recover the account on a new device.
- You are responsible for activity on your account and for keeping any linked credentials secure. Tell us promptly if you believe your account has been accessed without your permission.
- Accounts are personal. You may not sell, rent, share, gift, or transfer your account, and you may not buy or use an account created by someone else.
- Choose a display name that follows the conduct rules. We may change display, guild, or team names that break them.
- You can delete your account at any time in the game (Settings → Delete Account) or by contacting support — see the Privacy Policy for how deletion works. Deletion is permanent and forfeits remaining virtual items and currency.
3. Your license to play
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to install and play the game on compatible devices you own or control, for your own non-commercial entertainment. Everything in the game — code, art, audio, characters, names, stories, balance data, and the game itself — is owned by us or our licensors and is protected by intellectual property laws. Except for this license, no rights are transferred to you. You may not copy, distribute, sell, or create derivative works from the game or its content except where the law allows it regardless of these terms.
4. Virtual items and currency
- The game includes virtual currencies (such as gold and gems) and virtual items (such as heroes, gear, runes, chests, and tickets). These are features of the game service, licensed to you under these terms — not your property.
- Virtual items and currency have no real-world value. They cannot be redeemed for money, sold or traded outside the game, or transferred between accounts except through features we provide in the game (such as in-game gifting).
- Buying, selling, or advertising virtual items, currency, or accounts for real money ("real-money trading") is prohibited, whether inside or outside the game.
- The game is a live service: we balance and tune it continuously. We may add, change, rebalance, or retire virtual items, currencies, heroes, game modes, and prices at any time. Where a change would materially reduce something you paid for, we will act reasonably — for example by providing a comparable replacement or in-game compensation.
- We may correct account balances or remove items that were obtained through a bug, error, fraud, or breach of these terms.
5. Purchases and refunds
- Optional in-app purchases are processed entirely by Google Play under Google's own terms and payment policies. We never receive your card or billing details.
- Prices are shown before you buy and may change over time. Purchases are for the virtual items or currency described at the point of sale, delivered to your account.
- Refunds: purchases of virtual items and currency are final once delivered, except where a refund is required by law or offered by Google Play's refund policy. To request a refund, use Google Play's refund process; you can also contact our support team and we will help where we reasonably can.
- EU/UK buyers: by purchasing virtual content you consent to it being delivered to your account immediately, and acknowledge that you lose the statutory 14-day withdrawal right once delivery has begun.
- If a purchase is refunded or charged back, we may remove the purchased items or an equivalent value from the account, and repeated abusive chargebacks may lead to suspension.
- Nothing in this section limits rights you have under consumer law — see Your consumer rights.
6. Random rewards
- Some game features award items by chance — for example hero summons, chests, and prize wheels. For these features, the game shows the applicable drop rates in-game before you spend currency or open the reward.
- When you buy or open a random-reward feature, you are buying the chance described by those rates, not any specific item. Duplicate or lower-rarity outcomes are part of the feature working as described.
- Some features include published safeguards (such as guaranteed outcomes after a stated number of attempts). Where offered, these are described in the feature itself.
- Outcomes are generated server-side and cannot be influenced by anything outside the published mechanics.
7. Gift and promotional codes
We may issue codes redeemable for in-game rewards. Codes have no cash value, may be limited to one redemption per account, may expire or be discontinued at any time, and may not be sold or exchanged. We may withhold or reverse rewards from codes that were obtained or redeemed fraudulently, or distributed without our permission.
8. Conduct rules
HeroBrawl has public chat, guild and private messaging, and player-chosen names that other players see. When using them, you must not:
- harass, threaten, bully, or abuse other players, or encourage others to do so;
- post hateful, discriminatory, sexually explicit, or otherwise objectionable content;
- share your own or anyone else's personal information (real names, addresses, contact details, social accounts);
- impersonate other players, NewFound Studios staff, or anyone else;
- spam, advertise, or solicit — including promoting real-money trading, cheats, or other services;
- post or link to anything illegal, or use the game to commit or promote illegal activity.
Chat is subject to automated filtering and may be reviewed by human moderators. We may remove content, restrict chat, or suspend accounts that break these rules — see Enforcement. You keep ownership of what you write, but you grant us a worldwide, royalty-free license to store, display, and moderate it as needed to operate the game's social features.
9. Fair play
The game's outcomes are computed and validated on our servers to keep play fair for everyone. You must not:
- use cheats, hacks, mods, bots, scripts, macros, or any automation to play or gain an advantage;
- tamper with the game client, its memory, or its network traffic, or use software that does;
- exploit bugs. If you find one — especially one that grants items, currency, or progress — stop using it and report it to support. Knowingly abusing a bug is treated the same as cheating;
- reverse-engineer, decompile, or extract the game's code or assets, except where the law permits it regardless of these terms;
- interfere with the servers or other players' access — including denial-of-service, load-testing, probing, or attempting to access accounts or systems that are not yours;
- use the game for commercial purposes without our written permission.
10. Enforcement
- If an account breaks these terms we may, depending on severity and history: issue a warning, remove content, restrict features such as chat, remove improperly obtained items or currency, temporarily suspend the account, or permanently ban it.
- For serious violations — cheating, fraud, real-money trading, or abuse targeting other players — we may ban immediately and without prior warning.
- Banned accounts forfeit access to their virtual items and currency for the duration of the ban. We do not refund purchases on accounts banned for breach of these terms, except where the law requires otherwise.
- If you believe we got it wrong, contact support with your player ID and we will review the decision.
11. The game is a live service
- Playing requires a compatible device and an internet connection; progress is stored on our servers. You are responsible for your device and data charges.
- We update the game regularly. Updates may be required to keep playing, and may change or remove features, content, and balance.
- The game may be unavailable during maintenance, outages, or events beyond our control. We work to keep downtime short but do not promise uninterrupted availability.
- We may suspend or discontinue the game (in whole, in part, or in a particular region). If we discontinue the game entirely, we will give reasonable advance notice — at least 30 days via the game or this website except where circumstances beyond our control prevent it. Virtual items and currency end with the service; where the law gives you rights in that situation, those rights are unaffected.
12. Feedback
We welcome suggestions and feedback. If you send us ideas about the game, you agree we can use them without restriction or compensation — this lets us act on community suggestions without legal complications.
13. Third-party services
The game is distributed through Google Play and runs on third-party infrastructure (including Microsoft PlayFab and Azure). Your use of Google Play is governed by Google's own terms. If you downloaded the game from Google Play, Google is not a party to these terms and has no responsibility for the game or its content.
14. Disclaimers
The game is provided "as is" and "as available". To the extent permitted by law, we make no warranties beyond those set out in these terms — including that the game will be uninterrupted, error-free, or that any particular content, feature, or balance state will remain available. This does not exclude warranties or guarantees that the law does not allow us to exclude.
15. Liability
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law — including liability for death or personal injury caused by negligence, for fraud, or under non-excludable consumer guarantees. Subject to that:
- we are liable for damage we cause deliberately or through gross negligence, and for breach of essential obligations of these terms;
- we are not liable for indirect or consequential losses, loss of data caused by events outside our reasonable control, or losses caused by your breach of these terms or misuse of the game;
- for anything else, our total liability to you is limited to the greater of (a) the amount you paid us for the game in the 12 months before the claim arose and (b) AUD 100.
16. Your consumer rights
These terms do not take away rights that consumer law gives you and that cannot be waived by agreement.
- Australia: our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies those guarantees or your remedies for their breach.
- EEA/UK: you retain all mandatory rights under your local consumer protection law, including remedies for digital content that is faulty or not as described.
- Elsewhere: where your local law grants non-waivable consumer rights, those rights apply notwithstanding anything else in these terms.
17. Governing law and disputes
These terms are governed by the laws of Australia, and disputes may be brought in the Australian courts — except that if you are a consumer, you keep the protection of any mandatory laws of the country you live in, and you may bring proceedings in your local courts where the law gives you that right.
If you have a problem, please contact support first — most issues can be resolved quickly and informally.
18. Changes to these terms
We may update these terms as the game evolves. If we make material changes, we will notify you in the game or on this website before they take effect, and update the effective date above. Continuing to play after a change takes effect means you accept the updated terms; if you do not accept them, stop playing and (if you wish) delete your account.
19. General
- These terms and the Privacy Policy are the entire agreement between you and us about the game.
- If part of these terms is found unenforceable, the rest remains in effect.
- If we don't enforce a provision, that is not a waiver of our right to enforce it later.
- You may not assign your rights under these terms. We may assign ours as part of a merger, acquisition, or sale of the game, provided your rights are not reduced.
- Sections that by their nature should survive termination (including intellectual property, liability, and dispute provisions) survive it.
